RE:  State of Vermont v. Elsie Oscarson

Dear Elsie:

    Pursuant to our phone conversation, the State is willing to enter into the following plea agreement:

    1. The two sexual assaults carrying two life sentences would be amended to 4 lewd acts;

    2.  You would enter an Alford plea denying that you did anything wrong.  Each lewd act charge has a possible 5 year sentence;

    3.  The Court would be capped at 7 years to serve in jail and we would be free to argue that you get out now.  You would get credit for time served.

    Worse case, you would serve about 2 more years -- best case, you would get out now.

    4.  The balance of the sentence would be on probation with the following conditions:

        a.  Counseling as recommended by probation;

        b.  No contact with your minor children; and

        c.  You would have no more children while on probation.
